Your health is your responsibility. The
management and staff of Tempus Leisure Limited are dedicated
to helping you take every opportunity to enjoy your participation
in our event. With this in mind, we have carefully considered what
we can reasonably expect of each other.

Our commitment to you
1.
We will respect your personal decisions, and allow you to make your
own decisions about what exercise you can carry out. However, we
ask you not to exercise beyond what you consider to be your own
abilities.
2.
We will make every reasonable effort to make sure our event are
organised to accepted safe operational standards for you to
enjoy.
3.
We will make all reasonable steps to ensure our staff are trained
to deliver our events to industry standards.
4.
If you tell us you have a disability which puts you at a
substantial disadvantage in accessing our event, we will consider
what adjustments, if any, are reasonable for us to make.

Your commitment to us
1.
You should not exercise beyond your own abilities. If you know or
are concerned that you have a medical condition which might
interfere with your safe participation in our event, before you
enter you should seek advice from a relevant medical professional
and follow that advice.
2.
It is the decision of the user, not the event organiser, to
determine whether he or she is fit enough to exercise. If the user
is in any doubt, the user should seek medical advice. It is up to
the user where to seek that medical advice.
3.
You should let us know immediately, if you feel unwell whilst
participating in one of our events. Our staff are not qualified
Doctors, but there will be first aid provision in attendance at our
events.
4.
If you have a disability, you must follow any reasonable
instructions to allow you to complete our event safely.

This Health Commitment Statement sets the
standards that Tempus Leisure Limited and the event
participant can reasonably expect from each other in regards to the
health of the participant.
This statement is for guidance only. It is not
a legally binding agreement between you and us and does not create
any obligation which you or we must meet.

Terms and Conditions
1.
Definitions
“Code of Conduct” means any code of conduct
specified by the Event Organiser in relation to the Event.
"Conditions" means these terms and conditions
of entry for the Event.
"Entry Form" means the website pages which
must be completed in order to participate in the Event.
"Event" means the event named on the Entry
Form.
"Event Organiser" means Tempus Leisure
Limited, Company Number 06864478 whose registered office is
Gyllyngdune Cottage, 41 Melvill Road, Falmouth TR11 4AR and its
appointed staff and / or agents.
"Fee" means the entry fee for the Event as set
out in the Entry Form.
“National Governing Body” means any national
governing body in relation to the Event.
"Participant" means the person named on the
Entry Form who will be participating in the Event.
“Parties” means the Event Organiser and the
Participant and each shall be a “Party”.
2.
Acceptance of Conditions
2.1 These Conditions shall
apply in place of and prevail over any terms or conditions (whether
or not in conflict or inconsistent with these Conditions) contained
or referred to in any documentation submitted by the Participant or
in correspondence or elsewhere or implied by trade custom, practice
or course of dealing. A variation of these Conditions is only valid
if the Event Organiser gives notice to the Participant in writing
in any official Event material or correspondence prior to the Event
(including via email). The Participant shall be deemed to have
accepted these Conditions upon completion of the Entry Form.
3.
Participation
3.1 Where a Participant
has been asked to declare if they have a valid membership, permit,
licence or affiliation to a National Governing Body during the
Event entry process and such membership, permit, licence or
affiliation offers the Participant a reduction in their Fee or part
refund of their Fee the Participant shall on request of the Event
Organiser produce appropriate evidence of such membership, permit,
licence or affiliation when registering on the day of the Event. In
the event that the Participant is unable to produce such evidence
the Event Organiser will not offer any reduction or refund in their
Fee as applicable and may impose the sanctions detailed in
Condition 3.8
3.2 The Participant is aware
of the nature of the Event and the associated risks involved and
agrees that he/she is physically capable of competing in the Event
and is to be solely responsible for his/her actions and the Event
Organiser, its officers, employees, agents, affiliates, associated
companies, sponsors or medical advisers are not responsible for any
injury or illness that the Participant may suffer as a result of
his/her participation in the Event. The Participant accepts that
should any medical or physical condition arise prior to the Event
which is likely to affect his/her ability to compete, the
Participant will withdraw from the Event in accordance with these
Conditions.
3.3 The Participant agrees
to abide by all applicable rules and regulations including any Code
of Conduct and any relevant National Governing Body regulations.
The Participant shall not be entitled to a refund of the Fees if he
or she is disqualified from the Event as a result of an
infringement of these Conditions, Code of Conduct or any relevant
National Governing Body rules and regulations.
3.4 The Participant must
complete the registration process as specified in the information
pack which will be issued in advance of each Event by the Event
Organiser.
3.5 Where an Event requires
the use of any equipment and / or personal protective clothing it
shall be the Participant’s sole responsibility to provide such
equipment and / or personal protective clothing which shall be in a
good condition in order to comply with the Code of Conduct and / or
relevant National Governing Body rules and regulations as
appropriate.
3.6 The Event Organiser may
introduce cut off times as it sees fit as part of the Event rules,
being limits on the time permitted to complete sections of the
Event (as initiated by the Event Organiser at its sole discretion)
to ensure the safe and proper running of the Event. Participants
may be instructed to withdraw from the Event where they fail to
complete sections within the specified cut off times.
3.7 The Event Organiser
reserves the right at any time to remove Participants from the
Event or prevent Participants participating in the Event if it
considers such action necessary for safety reasons or to ensure the
proper enjoyment of the Event by other Participants or for any
other reasonable reason. No refund of the Fee shall be made if the
Participant has acted negligently, maliciously, with wilful
misconduct or otherwise without due care and attention for the
Event or other Participants so as to cause his or her removal.
3.8 The Event Organiser
reserves the right to impose sanctions as identified in any Code of
Conduct which may include time penalties, disqualification from the
Event and/or disqualification from associated events or other
events that are offered by the Event Organiser.
3.9 While the Event
Organiser takes every care with the staging of the Event, the
Participant acknowledges that personal accident and personal items
insurance is his or her sole responsibility.
3.10 The Participant is
required to complete all age related information required on the
Entry Form and shall ensure that all age limitations are complied
with according to the Code of Conduct and National Governing Body
rules and regulations of the Event.
3.11 All decisions and
rulings by the Event Organiser, its employees and its agents are
considered final. Accordingly, the Participant will comply with all
Event rules and all instructions and guidelines given by stewards,
marshals, and safety personnel. The Participant acknowledges and
agrees that the Event Organiser will organise and run the Event and
will have sole authority and be the final arbiter on all decisions
relating to the safety, running and organisation of the Event, the
rules of the Event, the timings/finish times and the overall
position.
3.12 These Conditions are
personal to the Participant and the Participant may not assign any
of its rights or obligations under these Conditions without the
prior written consent of the Event Organiser. The Participant
represents and warrants that the entry to the Event is personal to
the Participant and entry into the Event will not be donated free
of charge or otherwise transferred, is not purchased as part of any
form of business or commercial activity (save as expressly
authorised by the Event Organiser), and in particular, may not be
resold or offered for resale whether at a premium or otherwise and
may not be used for advertising, use as a prize (including in
competitions and sweepstakes), travel packages, or for any other
trade purposes. Donation, transfer, resale or attempted resale is
grounds for seizure or cancellation of the Participant’s entry into
the Event without a refund or other compensation.
3.13 The Participant
acknowledges and accepts that circumstances concerning an Event may
change from time to time for reasons beyond the Event Organiser’s
reasonable control or otherwise, without the Event Organiser
incurring any liability and without any rights to withdrawal being
accrued by the Participant other than set out in Condition 4 below.
The Event Organiser shall use reasonable means to communicate any
changes to the Participant as soon as reasonably practicable.
4. Bookings
and Payments
4.1 The Participant must pay
the Fee when they enter using the online registration process on or
before the Event as specified by the Event Organiser. Fees for
Events are subject to periodic review by the Event Organiser.
4.2 The Participant shall
not be eligible or entitled to participate in the Event until full
payment of the Fee has been received by the Event Organiser. No
payment shall be deemed to have been received by the Event
Organiser until cleared funds are confirmed.
4.3 The Event Organiser
reserves the right at its sole discretion and in extenuating
circumstances to accept Entry Forms and Fees after the closing date
specified by the Event Organiser and to modify the process for
entry to the Event.
4.4 The Participant may not
assign his/her entry to another person without the permission of
the Event Organiser. Infringement of this Condition compromises the
integrity of the Event and linked events and will normally result
in disqualification of the Participant and the person to whom his
or her entry was assigned from the Event and future events
including linked events.
4.5 Participants shall
notify the Event Organiser of contact details including their
emergency contact details in the Entry Form and inform the Event
Organiser of any changes to their personal contact details as soon
as possible.
5.
Withdrawal, Cancellations or Alterations
5.1 The Participant will
receive a full refund of the Fee if the Event is cancelled with no
further liability of the Event Organiser whatsoever arising from
such cancellation.
5.2 The Participant
acknowledges that places on the Event are limited and payment of
the Fee and reservation of the place has an affect on logistics and
the subscription for the Event. Accordingly, any Participant
withdrawing from an Event shall not be entitled to a refund unless
notice of withdrawal is given in accordance with Condition 5.4
prior to the closing date as specified by the Event Organiser and
the Event Organiser is able to find a replacement for the
Participant by offering their place to another interested
individual on the Event waiting list.
5.3 Should places in any
Event be full, interested individuals will be offered the option of
joining a waiting list. If a place then becomes available
reasonable care will be taken to contact interested individuals on
the waiting list to invite them to register for the Event
5.4 Notice of withdrawal
from the Event must be communicated to the Event Organiser by the
Participant via the relevant Event email inbox which is accessible
via the contacts tab on the Event website. Withdrawals will
not be accepted by telephone.
5.5 The Event Organiser
reserves the right to change the time, route, format or cancel
parts of the Event due to circumstances beyond its reasonable
control at short notice. In these circumstances the Participant
will not be entitled to any refund of the Fee and there shall be no
further liability of the Event Organiser whatsoever arising from
such change.
6.
Limitation of Liability
6.1 The Event Organiser
excludes all warranties, conditions and other terms implied by
statute or common law are, to the fullest extent permitted by
law.
6.2 Nothing in these
Conditions shall exclude or limit the liability of the Event
Organiser:
6.2.1 for death or personal
injury caused by the Event Organiser’s negligence;
6.2.2 for fraud or
fraudulent misrepresentation; or
6.2.3 for any other
liability which cannot be restricted by law.
6.3 Subject to Condition 6.2 the Event Organiser shall under no circumstances
whatsoever be liable to the Participant whether in contract, tort
(including negligence), breach of statutory duty, or otherwise, for
any damage, losses, actions, claims, demands, proceedings, costs,
charges, expenses or any indirect or consequential loss arising
under or in connection with the Event.
6.4 The Event Organiser
shall not be liable for any actions of any spectators or other
third parties.
6.5 If during an Event the
Participant uses a replacement bicycle or other equipment provided
by a third party including but not limited to that supplied by a
sponsor of an Event, the Participant shall enter into a contractual
agreement in respect of the use of such replacement bicycle or
equipment at the request of the third party. For the avoidance of
doubt and subject to Condition 6.2, the Event Organiser shall not
be liable to the Participant whether in contract, tort (including
negligence), breach of statutory duty, or otherwise, for any
damage, losses, actions, claims, demands, proceedings, costs,
charges, expenses or any indirect or consequential loss arising
from or in connection with the use of such replacement bicycle or
equipment.
7. Publicity
and Results
7.1 The Participant consents
to the Event Organiser taking photographs or video footage at the
Event. Photographs and video footage will be used by the Event
Organiser for promotional purposes and may include printed
documents or media, editorial coverage, advertising press and use
on the internet. Participants who do not wish for their images to
be used in such ways must inform the Event Organiser prior to the
Event.
7.2 Any film, photographs
(by camera or mobile phone), or any other recording of moving or
still picture, and all intellectual property in connection
therewith (including but not limited to copyright) shall remain the
property of the Event Organiser, and where such intellectual
property does not automatically vest in the Event Organiser, these
Conditions shall constitute a legally binding assignment thereof
and/or the Participant shall sign all reasonable documentation
required to give affect thereto.
7.3 The Event Organiser will
use best endeavours to provide an Event finish time for the
Participant however it cannot be held responsible for any technical
issues which prevent the provision of such information to the
Participant.
8.
General
8.1 All Participant
information shall be processed in accordance with the Data
Protection Act 1998.
8.2 These Conditions (and
the documents referred to in them) constitute the entire agreement
and understanding of the Parties and supersede any previous
agreement between the Parties relating to the Event.
8.3 Nothing in these
Conditions shall constitute or be deemed to constitute a
partnership between the Parties hereto or constitute or be deemed
to constitute either Party as agent of the other for any purpose
whatsoever and neither Party shall have authority or power to bind
the other or to contract in the name of the other in any way or for
any purpose.
8.4 No waiver by either
Party of a breach or a default hereunder shall be effective unless
in writing and signed by both Parties and any such waiver shall not
be deemed to be a waiver of any subsequent breach or default of the
same or similar nature.
8.5 To the extent permitted
by law all provisions of these Conditions shall be severable and no
provision shall be affected by the invalidity or unenforceability
of any other provision.
8.6 The Event Organiser
reserves the right to amend these Conditions and the Code of
Conduct from time to time.
8.7 These Conditions shall
be interpreted in accordance with the laws of England and Wales and
any dispute arising hereunder shall be subject to the exclusive
jurisdiction of the English Courts.
